Frequently Asked Questions

TDS Compliance & Final Returns involve reviewing and completing applicable tax deduction, deposit, quarterly statement filing, correction and certificate-related obligations before or during business closure.

If the business has applicable TDS or TCS reporting obligations, the relevant statements and outstanding compliance matters must be addressed according to the applicable provisions. Closure does not automatically remove pending tax obligations.

For periods governed by the Income-tax Act, 1961, Form 24Q is used for salary TDS, Form 26Q for specified resident non-salary deductions and Form 27Q for specified non-resident deductions. From Tax Year 2026-27, the corresponding regular statement forms include Form 138, Form 140 and Form 144 under the Income-tax Act, 2025. The applicable form depends on the reporting period and transaction.

The general quarterly due dates for regular TDS statements are 31 July for April-June, 31 October for July-September, 31 January for October-December and 31 May for January-March. Special challan-cum-statement forms and TCS statements may have different deadlines. Applicable deadlines should be verified for the relevant period.

Delay or failure in filing can result in applicable late filing fees, penalties and other consequences under the relevant income tax provisions. Interest may also apply where tax has not been deducted or deposited within the prescribed time.

Depending on the applicable law and reporting period, pending statements may still need to be filed after operations stop or closure proceedings begin. The entity's legal status, TAN and outstanding obligations should be reviewed before proceeding.

A regular TDS statement reports tax deductions and deposits for the relevant period. A correction statement is filed to rectify eligible errors or omissions in a previously submitted statement, such as incorrect PAN, deductee details or challan information.

Applicable TDS certificates must be issued to deductees according to the prescribed requirements. For example, Form 16 is generally relevant to salary TDS, while Form 16A applies to specified non-salary deductions. The certificate obligations should be reviewed as part of final compliance.

No. Business closure does not automatically cancel a TAN. Applicable pending TDS or TCS obligations should be reviewed and the relevant TAN cancellation or surrender procedure should be considered separately where appropriate.

The timeline depends on the number of pending periods, availability of challans and deductee information, outstanding defaults, correction requirements and complexity of the records. The process can begin once the necessary documents have been reviewed.
