Trademark Registration helps protect your brand identity, including eligible names, logos, symbols and other distinctive marks used for goods or services. Registration in India provides statutory rights in relation to the registered mark and the goods or services covered by the registration.
Establish statutory protection for your registered trademark within the scope of the registration and applicable law.
Obtain the legal right to use the registered mark for the specified goods or services, subject to applicable conditions.
Help distinguish your products or services from those offered by other businesses in the marketplace.

Trademark applications in India are examined by the Trade Marks Registry under the Trade Marks Act, 1999 and the Trade Marks Rules, 2017.
Search the existing trademark database for identical or similar marks and assess potential conflicts for the intended goods or services.
Identify the appropriate class or classes under the Nice Classification system and define the goods or services to be covered.
Prepare Form TM-A with the applicant's details, trademark representation, class information and the appropriate statement of use or proposed use.
Submit the application through the official e-filing portal and pay the applicable government fee for each mark and class.
The Registry examines the application. If objections are raised, the applicant may need to submit a response and attend a hearing, where scheduled.
An accepted application is published in the Trade Marks Journal, allowing third parties the statutory opportunity to oppose registration.
Third parties generally have four months from publication to file an opposition. If there is no opposition, or opposition proceedings are resolved in the applicant's favour, the Registry may proceed to registration, subject to applicable requirements.
The overall timeline varies depending on examination, objections, hearings, opposition and other Registry proceedings. Filing an application does not mean the trademark is already registered.
Individuals and eligible legal entities can apply to register trademarks in India. The proposed mark must satisfy the requirements of the Trade Marks Act and applicable Rules.
Individuals, including eligible sole proprietors, may apply in their own name for a trademark they own or intend to use.
Companies, LLPs, partnership firms and other eligible applicants may apply using the appropriate legal name and applicant details.
The mark should be capable of distinguishing the applicant's goods or services and must satisfy the applicable legal requirements.
The application must specify the goods or services for which protection is sought under the appropriate classification.
The application should accurately state whether the mark is already in use or is proposed to be used. Prior-use claims require the applicable supporting evidence and affidavit.
The mark must not fall within applicable grounds for refusal, including prohibited marks or marks that conflict with earlier trademarks under the law.
A trademark search can help identify potential conflicts but cannot guarantee acceptance or registration. The Registry makes the final decision under applicable law.
The documents required depend on the applicant category, trademark type and whether prior use is claimed. Prepare the relevant information before filing.
Full applicant details and address for service to be entered in the application.
Identity and supporting details as required for the applicant category and filing process.
Relevant supporting certificate if claiming the applicable reduced government filing fee as a startup or small enterprise.
Authorisation documents, where an agent or representative files the application on the applicant's behalf.
Certificate of incorporation, LLP registration or other relevant entity registration documents, where applicable.
Legal applicant name and address details matching the relevant supporting records.
Information about the authorised person signing or submitting the application on behalf of the entity.
Valid supporting certificate where the applicant claims the relevant government fee concession.
Clear wording or a legible representation of the proposed word mark, logo or other eligible mark type.
Description of the products or services for which registration is requested and the relevant class information.
If prior use is claimed, prepare the prescribed user affidavit and supporting evidence of use as applicable.
Accurate information about when the mark was first used or confirmation that it is proposed to be used.
Relevant invoices, packaging, advertisements, website material or other supporting evidence when required.
The final checklist depends on the application details. A mark filed as proposed to be used generally does not require a prior-use affidavit, whereas a claim of earlier use must be supported as prescribed by the Rules.
